Step 2: I-140 Immigrant Petition for Alien Worker

Submitting an I-140 Immigrant Petition for Alien Worker is the second step in the process of application for permanent residency based on employment (EB-2). This second step should be taken after the labor certification application has been approved. The immigrant petition, Form I-140, will be completed by the International Center's scholar coordinator with information received from the scholar.

Documents needed from the department and/or beneficiary:

  1. $580 check made payable to "Department of Homeland Security" provided by either the hiring MU department or the scholar.
  2. Letter from the hiring department stating its intent to employ the beneficiary in a tenured or tenure-track faculty position contingent on the adjustment of status to permanent resident.
  3. An updated curriculum vitae (resume) with a current listing of publications the beneficiary has authored or co-authored.
  4. A copy of the beneficiary's highest degree, with transcripts; if the degree is not in English, a notarized translation must be provided.
  5. True copies statement of documents submitted by the beneficiary.

The scholar coordinator will write a cover letter for the petition, add the original approved labor certification form and submit all documents to U.S. Citizenship and Immigration Services (USCIS). USCIS will review the application and notify the scholar coordinator when it has been approved or will request additional information with a request for evidence.
